Legal aid for family law: who qualifies and how to apply

Legal aid covers solicitor costs for people who cannot afford representation. It is means-tested and merits-tested. In family law, it remains available for domestic abuse cases, some children cases, and mediation.

Domestic abuse evidence gateway

If you are a victim of domestic abuse, you can access legal aid for private family law proceedings if you have supporting evidence: a police report, conviction, injunction, GP letter, or letter from an IDVA. The Legal Aid Agency (LAA) accepts 16 categories of evidence.

Means test

Your gross income must be below £2,657 per month (2024/25). Your disposable income (after allowances) must be below £733 per month, and disposable capital below £8,000. Your home and car are excluded from capital unless they are very high value.

Finding a legal aid solicitor

Use the Find a Legal Aid Adviser tool on gov.uk. Search by postcode and category of law (Family). Not all family solicitors hold a legal aid contract — confirm before booking an appointment.

Help with mediation

Mediation is legal-aid funded for those who qualify, even if the other party does not qualify. Legal aid also covers legal representation at a First Hearing in child arrangements cases involving domestic abuse.
